1. About Galactic Hosting

Galactic Hosting is a registered business name operated by Peter Benjamin Charlton, sole trader, ABN 91 635 830 529, in New South Wales, Australia.

In these Terms, “Galactic Hosting”, “we”, “us” and “our” mean Peter Benjamin Charlton trading as Galactic Hosting, ABN 91 635 830 529. “Galactic+” means the paid Discord bot hosting service described in these Terms.

2. Acceptance of Terms

By creating a Galactic+ account, purchasing a subscription, or using Galactic+, you agree to these Terms and the policies linked from them. If you use Galactic+ for an organisation, you represent that you have authority to accept these Terms for that organisation.

If you do not agree, do not purchase or use Galactic+. Our Privacy Policy, Refund Policy, and Acceptable Use Policy explain additional terms relevant to the service.

3. Eligibility and Age

You must meet Discord's minimum age requirement applicable to your country or region and be permitted to hold and use a Discord account. Galactic Hosting does not independently verify every user's age.

If you are under 18, you may use Galactic+ only if you otherwise meet Discord's applicable minimum age requirement and have permission from a parent or legal guardian where required by law. If you purchase a subscription, you represent that you are legally able to enter the transaction or have appropriate parent or guardian permission.

4. Galactic+ Service

Galactic+ provides managed, resource-limited hosting for customer-operated Discord bots. Depending on your entitlement, the service may include one or more bot servers, hosting resources, a hosting-panel account, provisioning, lifecycle controls, and service notifications.

Features and technical arrangements may evolve. Any material change affecting an existing paid entitlement will be handled prospectively and subject to applicable law.

5. Discord Account Requirement

Discord authentication is the sole customer sign-in mechanism for Galactic+. Your Discord user ID is the stable identity for your Galactic+ account. An email address obtained from Discord or supplied through your account may be used for hosting-account provisioning, service contact, or related operational purposes, but it is not your Galactic+ authentication identity or a password-login credential.

You need access to an eligible Discord account to sign in. Changes to, restrictions on, or loss of your Discord account may affect your ability to access Galactic+, even where a hosting email remains on file.

6. Accounts and Security

You are responsible for securing your Discord account, active Galactic+ sessions, hosting-panel credentials, bot tokens, API keys, and other secrets. You must provide accurate account and contact information, must not access another customer's account or server, and must not use account sharing or multiple identities to evade eligibility, billing, security, or resource controls.

Notify legal@galactichosting.net or use our support options promptly if you believe your account, session, or hosted server has been compromised.

7. Subscriptions

Galactic+ is a recurring paid subscription. As at the effective date, the standard offer is AUD $4.99 per month. The price, currency, billing interval, trial, discount, and other terms that apply to you will be displayed before you confirm Checkout. A free trial or promotion may temporarily change the initial amount or timing.

Your subscription renews automatically until it is cancelled or otherwise ends under these Terms. If the recurring price for an existing subscription changes, we will give any notice required by applicable law before the change takes effect.

8. Free Trials

Eligible new Galactic+ customers may receive a 7-day free trial. A trial is not guaranteed. Eligibility is determined by Galactic Hosting's systems and may take account of prior trial, subscription, promotion, Galactic+ account, and Discord identity history. The default offer is limited to one trial per eligible Galactic+ user or account.

Where offered, the applicable trial duration and conditions will be displayed before Checkout. A payment method may be required. Unless you cancel before the trial ends, the trial will convert automatically to the recurring paid subscription at the price shown before confirmation.

Previous trial or paid-subscription history may make you ineligible. A promotion may replace the default trial, and offers do not stack unless expressly stated at Checkout. Galactic Hosting may change or disable the default offer for future Checkouts without changing a trial already validly commenced, subject to applicable law.

9. Promotions

Promotions may be subject to eligibility criteria, start and end dates, redemption limits, new-customer restrictions, customer-specific restrictions, or a valid promotional code. The promotion terms displayed at Checkout apply to that redemption. Discounts, trials, and other offers normally do not stack unless expressly stated.

Galactic Hosting may withdraw, disable, or correct a promotion before redemption, subject to applicable law. We will not retrospectively remove a promotion already validly applied unless permitted by law. Misuse, fraud, or attempts to evade promotion controls may result in a redemption being refused or investigated.

10. Billing and Recurring Charges

Payments are processed by Stripe. By confirming Checkout, you authorise Stripe to charge the selected payment method for the amount and recurring interval shown, until your subscription is cancelled or otherwise ends. Any applicable price and charge timing will be shown before confirmation.

Stripe processes payment-card details under its own terms and privacy practices. Galactic Hosting does not store your full credit or debit card number. We may store limited billing records and Stripe customer, subscription, invoice, payment-status, and Checkout references needed to administer and reconcile your subscription.

11. Cancellation

You may cancel using the available Galactic+ billing controls. Cancellation is generally scheduled for the end of the current paid period or trial, as shown in your account. Unless access is restricted or terminated under another part of these Terms, your Galactic+ entitlement continues until that period or trial ends.

Cancel before a free trial ends if you do not want it to convert to a paid subscription. Cancellation stops future renewals but does not itself create or remove any right to a refund; refund requests are handled under section 14 and the Refund Policy.

12. Failed Payments and Grace Period

A failed or unresolved payment may place your subscription into a past-due state. Existing bot servers may continue during a grace period, while new bot creation and resource increases may be restricted. The current default grace period is 7 days, although the dates that apply to your subscription may be shown in your account or determined by the billing system.

After the grace period expires, Galactic Hosting may suspend affected bot servers. Servers are not automatically deleted merely because a payment fails, but data is not retained indefinitely and may be held only for a limited period under our operational, security, legal, and retention practices.

Successful payment recovery may restore access, and a suspension applied solely for billing reasons may be reversed after recovery. Restoration remains subject to security, legal, resource, and acceptable-use requirements.

13. Suspension

We may reasonably suspend or restrict all or part of Galactic+ where necessary to address overdue payment after an applicable grace period, a material breach of these Terms, a security threat, unlawful conduct, abuse, provider requirements, or risk to customers, third parties, or infrastructure.

Where practical and legally appropriate, we will give notice or an opportunity to remedy the issue. Suspension may prevent a bot from running or limit account actions; it does not necessarily cancel the subscription or immediately delete hosted data. Urgent action may be taken without advance notice where needed to protect the service or comply with law.

14. Refunds

You may request a refund for a Galactic+ charge by contacting legal@galactichosting.net. Galactic Hosting will generally consider reasonable requests promptly and in good faith. See the Refund Policy for further details.

An approved refund may result in cancellation or termination of the related subscription or service. If a full refund is issued for the current service period, we may suspend or end access to the refunded service. Where practical, download any files you need before access ends. Processing times may vary depending on Stripe and your financial institution.

Nothing in this section excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded under the Australian Consumer Law. Statutory remedies remain available where required.

15. Resource Limits

Your plan includes finite limits for bot instances, memory, storage, CPU, allocations, backups, databases, network use, and other resources as displayed or configured for the service. CPU and infrastructure limits are controlled by Galactic Hosting and may not be customer-adjustable. Resource figures describe maximum allocations, not a guarantee that every workload will achieve a particular level of performance.

You must not bypass or interfere with technical limits. We may restrict a workload that exceeds its entitlement, threatens stability, or violates the Acceptable Use Policy. Material changes to an existing paid entitlement will be managed prospectively and subject to applicable law.

16. Pterodactyl / Hosting Panel

Galactic+ uses Pterodactyl-backed infrastructure to provision and manage bot servers. A valid email address is required for the associated hosting-panel account. This email is used for hosting provisioning, contact, and account operation; it does not replace Discord as your Galactic+ sign-in identity.

Panel controls and displayed runtime information may differ from the Galactic+ dashboard. You are responsible for using the panel safely, protecting its credentials, and avoiding changes that interfere with managed provisioning, ownership records, resource controls, or service security. Panel access may be restricted alongside the related Galactic+ service.

17. Customer Bot Code and Content

As between you and Galactic Hosting, you retain any rights you already hold in your bot code, configuration, files, data, and content. You grant us and our hosting providers the limited permission needed to store, process, transmit, back up where applicable, and operate that material to provide and secure Galactic+.

You are responsible for your bot's code, commands, integrations, behaviour, credentials, and content; for obtaining necessary rights and permissions; and for complying with Discord's rules and applicable law. Do not upload secrets or personal information that your bot does not need.

18. Acceptable Use

You must comply with the Acceptable Use Policy. Among other things, you must not use Galactic+ for malware, credential theft, phishing, spam, unsolicited mass messaging, denial-of-service activity, botnets, cryptocurrency mining, unauthorised proxies, credential stuffing, illegal activity, harassment, malicious code, infrastructure compromise, or deliberate exhaustion or evasion of resource limits.

We may investigate, restrict, suspend, or terminate use where reasonably necessary to enforce these requirements, protect the service, or comply with law. Galactic Hosting may cooperate with lawful requests where required.

19. Backups and Data

You are responsible for keeping independent, current copies of your bot source code, configuration, credentials, and important data. Service backups are not guaranteed unless a specific backup feature is expressly offered to you. Galactic+ database backups do not necessarily include customer bot files held through Pterodactyl or hosting nodes, and any panel backup allocation does not remove your responsibility to keep your own copies.

Service interruption, hardware or software failure, customer error, malicious activity, or provider failure can result in data loss. Retention and recovery may vary by system and circumstance. Nothing in this section excludes any mandatory right or remedy available under applicable law.

20. Availability and Maintenance

Galactic Hosting aims to provide reliable service but does not guarantee uninterrupted or error-free availability. Planned maintenance, provider outages, infrastructure failure, network disruption, capacity constraints, emergency security work, or circumstances outside our reasonable control may affect Galactic+.

Where practical, we will communicate material planned work or significant service disruption through the website, dashboard, Discord, email, direct message, or another appropriate channel.

21. Third-Party Services

Galactic+ depends on third-party services and infrastructure, including Discord for authentication and bot operation, Stripe for payments, Pterodactyl for hosting management, and hosting, network, database, caching, monitoring, or alerting infrastructure where applicable. Your use of those services may also be governed by their terms and privacy practices.

Third-party changes, outages, restrictions, or termination can affect Galactic+. We will take reasonable operational steps within our control, but we do not control those providers. This section does not limit any responsibility that cannot lawfully be limited.

22. Termination

You may stop using Galactic+ and cancel your subscription as described above. We may terminate access for a material or repeated breach, serious abuse, unlawful activity, an unresolved security risk, provider requirements, or where continuing the service is no longer reasonably possible.

Where practical and lawful, we will use proportionate measures and provide notice or an opportunity to export available data before termination. Urgent protective action may occur without advance notice. Termination may result in loss of access to hosted servers and eventual deletion under applicable retention practices, so keep independent backups. Accrued rights, payment obligations, refund rights, and provisions intended to survive termination remain unaffected.

23. Consumer Rights

Nothing in these Terms excludes, restricts or modifies any guarantee, condition, warranty, right or remedy that cannot lawfully be excluded, including rights under the Australian Consumer Law. You may be entitled to a repair, replacement, refund, cancellation, compensation, or another remedy where required by applicable law.

Contractual trial, promotion, cancellation, suspension, backup, and refund terms do not replace mandatory statutory rights. Contact legal@galactichosting.net if you believe the service has not met an applicable consumer guarantee.

24. Limitation of Liability

To the maximum extent permitted by law, each exclusion or limitation in these Terms applies only to the extent that it is fair and lawful in the circumstances. Galactic Hosting is not responsible for loss to the extent it was caused by your breach of these Terms, unlawful or unsafe bot operation, failure to keep reasonable independent backups, or an event outside our reasonable control.

We do not seek to exclude liability for fraud, wilful misconduct, or any liability that cannot lawfully be excluded. Nothing in these Terms excludes, restricts or modifies any guarantee, condition, warranty, right or remedy that cannot lawfully be excluded, including rights under the Australian Consumer Law.

25. Changes to Terms

We may update these Terms to reflect service, provider, security, operational, or legal changes. Material changes may be communicated through the website, dashboard, Discord, email, direct message, or another appropriate channel. The updated Terms will state their effective or last-updated date.

Changes apply prospectively and do not retrospectively rewrite an already completed transaction. Mandatory consumer rights remain unaffected. If you do not accept a material change, you may cancel before it applies to your next renewal, subject to any rights available under law.

26. Governing Law

These Terms are governed by the laws of New South Wales, Australia, subject to any mandatory rights or protections that apply to you. Nothing in this section removes a right to bring a claim or seek a remedy in another forum where applicable law permits or requires it.
